Dear Prosecutors and Judges of J.M. Case and All HIV Criminal Cases
We cordially invite you to attend the Positive Sex workshop on HIV disclosure to sex partners. Perhaps after attending the workshop you will have a new found understanding of the complexities and risks involved in disclosure. Perhaps you will ask yourself how and why disclosure has become such a complex issue. Perhaps you may learn why non disclosure occurs at all. Perhaps you will begin to realize how public reactions to and perceptions of people living with HIV are in desperate need of immediate change to ease the disclosure process. Perhaps you will understand how the present state of affairs with disclosure is not rational as societal values ignore scientific evidence and place relieve individuals of all responsibility in society.
Perhaps you will learn how to balance the scales of responsibility for one’s own sexual health more evenly. Perhaps you will understand, how, using people living with HIV, as screening mechanisms for safe sex, is not rational. Perhaps you will decide that prosecuting and sentencing people living with HIV is part of a dangerous antiquated thought process which in fact increases rates of HIV transmission. Perhaps you will understand the toll this takes not only on people living with HIV, but on the entire community.
Perhaps in questioning your need to prosecute and pass sentences you will consider this quote by Galileo Galilei “By denying scientific principles, one may maintain any paradox”. We sincerely hope you come to a new understanding about disclosure and the paradoxes it presents as you think twice before prosecuting and sentencing. We are extending this invitation in good faith as a space to discuss the paradoxes.
